  • This Terms and Conditions Agreement (the "Agreement") is made and entered into on [Insert Date], by and between The Barn @ Stoney Hill, located at [Insert Venue Address], Durham, North Carolina (hereinafter referred to as the "Venue"), and [Insert Name of Renter] (hereinafter referred to as the "Renter").

    1. Definitions
    For the purposes of this Agreement, the following terms shall have the meanings set forth below:

    1.1 Event: The function to be held at the Venue as specified in the Booking Agreement.

    1.2 Booking Agreement: The document detailing the specific date, time, and other particulars of the Event.

    1.3 Deposit: The initial payment made by the Renter to secure the booking.

    1.4 Balance: The remaining amount to be paid after the Deposit.

    2. Booking and Payments
    2.1 Deposit: The Renter is required to pay a 50% Deposit to secure the Event date. This Deposit is non-refundable except as specified in the cancellation policy outlined in Section 3 of this Agreement.

    2.2 Final Payment: The Balance of the total rental fee is due no later than 45 days prior to the Event date. Failure to make timely payments may result in the cancellation of the booking at the Venue's discretion.

    2.3 Payment Methods: The Venue accepts the following payment methods: cash, checks, credit cards, Venmo, PayPal, Cash App, and Zelle.

    3. Cancellation Policy
    3.1 Cancellation by Renter: The Renter may cancel the Event by providing written notice to the Venue. Refunds for cancellations will be determined at the Venue’s discretion based on the proximity of the cancellation date to the Event date. Refunds may not be issued for cancellations made less than 45 days prior to the Event.

    3.2 Cancellation by Venue: The Venue reserves the right to cancel the Event due to unforeseen circumstances such as extreme weather, safety concerns, or non-compliance with this Agreement. In such cases, the Renter will receive a full refund of any payments made.

    4. Use of the Venue
    4.1 Event Duration: The Venue is available for use from 9:00 AM on the day of the Event until 11:00 PM. Use of the Venue beyond this timeframe requires prior approval and may incur additional fees.

    4.2 Setup and Cleanup: The Renter may begin setting up for the Event at 9:00 AM on the Event day. The Venue must be vacated, and all personal items removed by 11:00 PM. The Renter may be charged additional fees for cleanup services if the Venue is not left in the condition it was found.

    4.3 Decorations: The Renter is permitted to use decorations from the Venue’s Decor Barn. The use of confetti, glitter, or nails in the walls is strictly prohibited. All decorations must be approved by the Venue in advance.

    5. Vendors and Catering
    5.1 Approved Vendors: The Renter may use their own vendors for the Event. A list of preferred vendors is available upon request from the Venue.

    5.2 Food and Beverage: The Venue does not provide food or sell alcohol. The Renter is allowed to bring in their own food and beverages. The Venue provides a prep kitchen for use, subject to the terms outlined herein. All alcohol consumption must comply with North Carolina state laws and local ordinances.

    6. Noise and Conduct
    6.1 Noise Restrictions: DJs and live music must conclude by 9:00 PM on weekdays and by 10:00 PM on weekends, in accordance with local noise ordinances.

    6.2 Conduct: The Renter is responsible for the behavior of their guests. The Venue reserves the right to terminate the Event if behavior is deemed unacceptable or if it poses a risk to the safety of guests or property.

    7. Liability and Insurance
    7.1 Liability: The Renter assumes full responsibility for any damage to the Venue or its property caused during the Event. The Venue is not liable for any injury or loss suffered by the Renter or guests during the Event.

    7.2 Insurance: The Renter is encouraged to obtain event insurance to cover potential liabilities, including but not limited to property damage and personal injury.

    8. Accessibility and Parking
    8.1 Accessibility: The Venue is accessible to guests with disabilities, including a zero-entry front door and an ADA-compliant bathroom.

    8.2 Parking: Ample parking is available for guests at the Venue.

    9. Miscellaneous
    9.1 Pets: Service animals are welcome at the Venue. Other pets may be allowed on a case-by-case basis, subject to prior approval by the Venue.

    9.2 Fireworks and Sparklers: Sparklers are permitted outside the Venue. The use of fireworks is strictly prohibited.

    9.3 Photography: The Renter may take wedding photos at the Venue prior to the Event. Arrangements must be made in advance with the Venue.

    10. Governing Law
    This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles.

    11. Dispute Resolution
    Any disputes arising out of or in connection with this Agreement shall be resolved through mediation. If mediation fails, the dispute shall be settled in the courts of Durham County, North Carolina.

    12. Amendments
    This Agreement may only be amended or modified in writing, signed by both the Venue and the Renter. Any such amendments shall be incorporated into this Agreement and shall be subject to all terms and conditions herein.

    13. Entire Agreement
    This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or understandings of any kind. No other promises, representations, or agreements shall be binding unless in writing and signed by both parties.
